JAPER DEVELOPMENT CORPORATION AND/OR ATTY. MARIA ELVIRA RALLON-URSAL, PETITIONERS, VS. NATIONAL LABOR RELATIONS COMMISSION (SEVENTH DIVISION), MELCHOR B. DELASALA, RESPONDENTS.

Decisions / Signed Resolutions October 8, 2014 TWENTIETH DIVISION QUIJANO-PADILLA, J.:

QUIJANO-PADILLA, J.:

On September 8, 2014, herein petitioners filed a petition for certiorari under Rule 65 of the Rules of Court with application for a temporary restraining order and/or writ of preliminary injunction (WPI/TRO).[1]

In this court’s Minute Resolution[2] dated October 8, 2014, private respondent Melchor Delasala was required to file a Comment on the petition and on the application for WPI/TRO.

On November 3, 2014, private respondent Delasala filed his Comment.[3]

However, pending the resolution of this case and the application for WPI/TRO, petitioners filed a Motion to Dismiss[4] praying for the dismissal of their own petition on the basis of the Satisfaction of Judgment[5] entered into by the parties before the office of the Labor Arbiter Maria Ada Aniceto-Veloso. The Satisfaction of Judgment reveals that herein petitioner agreed to pay the judgment award in favor of herein private respondent and that the latter accepted the same through his counsel. It states, likewise, that the satisfaction of judgment shall cause the withdrawal of the instant petition.

WHEREFORE, considering the intent of the parties to put an end to this litigation through a voluntary satisfaction of judgment, petitioners’ Motion to Dismiss dated November 13, 2014 is GRANTED. The Satisfaction of Judgment dated November 12, 2014 is also NOTED and ADMITTED. And this case is hereby declared CLOSED AND TERMINATED and is therefore WITHDRAWN from the dockets of this Court.

SO ORDERED.
