In the Manifestation and Motion to Withdraw Petition dated January 9, 2014, petitioner Beton Bau Philippines, Inc., through counsel Jimenez Law Office, prayed that an order be issued allowing the withdrawal of the petition on the ground that the parties have entered into a Memorandum of Agreement before the National Conciliation and Mediation Board, which later became the basis for allowing the withdrawal of the assailed petition for certification election, per order dated July 29, 2013 of the public respondent’s Regional Office.

In their Comment dated March 14, 2014, private respondents Obrero Pilipino-Beton Bau Chapter, through counsel, Atty. Rodolfo M. Capoquian, averred that they have no objection to the Manifestation and Motion to Withdraw Petition filed by petitioner.
WHEREFORE, the Motion to Withdraw Petition is GRANTED and the petition DEEMED WITHDRAWN, and the case CLOSED and TERMINATED .
