IMPLEMENTING RULES AND REGULATIONS OF REPUBLIC ACT NO. 11915, “AN ACT DESIGNATING THE NATIONAL MUSIC COMPETITIONS FOR YOUNG ARTISTS PROGRAM (NAMCYA) AS THE NATIONAL YOUTH DEVELOPMENT PROGRAM FOR MUSIC, AND APPROPRIATING FUNDS THEREFOR”
The National Commision for Culture and the Arts (NCCA), in consultation and coordination with the NAMCYA Foundation, the Cultural Center of the Philippines (CCP), the Department of Education (DepEd), the Department of the Interior and Local Government (DILG), the Department of Information and Communications Technology (DICT), the Philippine Information AGency (PIA), the National Youth Commission (NYC), the Department of Tourism (DOT), the Commission on Higher Education (CHED), and other concerned agencies, promulgates the following Rules and Regulations to effectively implement the provisions of this Act.
Rule I
PRELIMINARY PROVISIONS
SECTION 1. Short Title. – These rulse shall be known as the Implementing Rules and Regilations (IRR) of Republic Act No. 11915, otherwise known as the “National Music Competitions for Young Artists (NAMCYA) Act, “hereinafter referred to as the Act.
SEC. 2. Declaration of Policy. – It is hereby declared the policy of the State to appropriately recognize, designate and support non-government organizations that have demonstrated pioneering, consistent and unassailable competence, effectiveness, and success in discovering and developing young musical artists and talents, and the preservation, development, and promotion of Philippine music and culture.
Rule II
DESIGNATION OF THE NATIONAL MUSIC COMPETITIONS FOR YOUNG ARTISTS PROGRAM (NAMCYA) AS THE PHILIPPINE NATIONAL YOUTH DEVELOPMENT PROGRAM IN MUSIC
SEC. 3. Designation as the Philippine National Youth Development Program in Music. – The National Music Competitions for Young Artists Program (NAMCYA) is hereby designated as the Philippined National Youth Development Program for Music to further promote high standards of excellence through its various music competitions, festivals, and other related activities.
RULE III
INCLUSION OF THE CELEBRATION OF THE NATIONAL MUSIC WEEK FOR YOUNG ARTISTS IN THE NAMCYA PROGRAM
SEC 4. Celebration of the National Music Week for Young Artists. – The Program shall, among others, include as its component the celbration of the National Music Week for Young Artists pursuant to Presidential Proclamation No. 1173, series of 1973.
RULE IV
OBJECTIVES OF THE NAMCYA
SEC. 5. Objectives. – Being the Philippine National Youth Development Program in Music, the NAMCYA shall have the following objectives:
(a) Discover outstanding musical talents through nationwide competitions and festivals designed for young Filipino musicians in all forms, styles and musical traditions in the country;
(b) Assist in the cultivation, development and advancement of outstanding young Filipino musicians through scholarships, trainings, performances, and other forms of incentives;
(c) Preserve, develop and promote Philippine music as an art and as an important component of cultural and social development;
(d) Establish a training program for music leaders, experts and teachers in order to maintain and cultivate the highest standard of musical training for the youth;
(e) Strengthen the multi-cultural fiber of the country by nurturing and developing gifted young musicians and musical ensembles from Philippine cultural communities, and preserve and disseminate their musical expressions and traditions;
(f) Encourage and support the creation and performance of works by young Filipino composers and making possible their publication and dissemination;
(g) Recognize artistic achievement through awards, grants and services, as well as endeavor to support the participation of NAMCYA winners in international events and scholarship programs;
(h) Undertake a continuing program of research, documentation, and publication of Philippine music for dissemination to schools and the general public;
(i) Receive and accept donations and other conveyances from government agencies, private entities, and other sources, including funds, materials, and services, by gratuitous title, in accordance with existing budgeting and accounting rules and regulations;
(j) Strengthen the character of the youth by developing and promoting a range of positive youth development skills that foster self-awareness, self-expression, discipline and values like love of family and country through music;
(k) Raise the standards of hiring personnel by engaging the services of qualified classical and traditional Filipino musicians, with at least a bachelor’s degree in Music Education, and known for their competence and proficiency in music, or in the use of musical instruments;
(l) Allocate funds in the technical production for the performing arts and the promotion of original Filipino music in various genres and style;
(m) Promote a vibrant music industry for the young workers and entrepreneurs that can fuel artistic growth, job creation, business investment, tourism and economic growth’
(n) Subsidize continuous research, market information, and assimilation of various forms, styles, genres, and music development representing the musical diversity of all the regions of the Philippines through webinars, conferences, and festivals;
(o) Maintain a database of Filipino youth participating in various NAMCYA organized activities; Provided, that the database as well as NAMCYA’s annual targets and programs shall be shared to the National Youth Commission or other relevant government agencies; and
(p) Invest in digital information systems in order to enhance the production and performance of creative works directed towards cultural development.
Rule V
FORMATION OF THE NAMCYA SPECIAL COMMITTEE AND ITS COMPOSITION
SEC. 6. NAMCYA Special Committee. – In order to carry out the objectives and enforce the entitlements under this Act, a Special Committee is hereby formed and composed of the following members:
(a) Chairperson of the National Commission for Culture and the Arts (NCCA) as Chairperson;
(b) Secretary of the Department of Education (DepEd) as member;
(c) Secretary of the Department of Tourism (DOT) as member;
(d) Secretary of the Department of the Interior and Local Government (DILG) as member;
(e) Secretary of the Department of Information and Communications Technology (DICT) as member;
(f) Director-General of the Philippine Information Agency (PIA) AS MEMBER;
(g) President of the Cultural Center of the Philipines (CCP) as member.
(h) Chairperson and Chief Executive Officer (CEO) of the National Youth Commission (NYC) as member; and
(i) President of the NAMCYA Foundation as member.
The members may designate an alternate to represent them in the NAMCYA Special Committee. The designation and/or change thereof, shall be in writing and submitted to the NAMCYA Special Committee. The alternate shall be entitled to attend meetings, vote, and exercise all the powers and rights of the permanent member.
SEC.6.1 Functions of the NAMCYA Special Committee. The NAMCYA Special Committee shall perform for the following functions:
(a) Facilittate the implementation of the NAMCYA within the mandates of NAMCYA Special Committee meber agencies;
(b) Receive and review the reports submitted bu the NAMCYA Foundation regarding the implementation of the NAMCYA and recommend the improvement of the same as may be necessary and
(c) Perfrom such other functionwithin the purview of this Act.
SEC. 6.2 Responsibilities of the Chairperson. – The Chairperson shall have the following responsibilities:
(a) Ensure that the goals and objectives set herein and the entitlements by the identified government agencies for the NAMCYA are constantly met and provided respectively;
(b) Regularly inform and remind the Vice Chairperson and members of the goals and objectives of this Act and its IRR, as well the functions of the NAMCYA Special Committee that they must perform accordingly;
(c) Preside over meeting of the NAMCYA Special Committee;
(d) Overseas the proper implementation of the NAMCYA;
(e) Represent the NAMCYA Special Committee on official matters; and
(f) Perfrom such other functions and duties as may be directed by the NAMCYA Special Committee.
SEC. 6.3 Meetings of the NAMCYA Special Committee.
(a) Regular Meetings – The NAMCYA Special Committee shall meet at least once every three (3) months at a place and time approved by a majority of all the members.
(b) Special Meetings – Special Mettings may be called by the Chairperson, or upon a request from the majority of the members, for valid and urgernt reasons and shall be held at a time and place to be specified in a notice to be furnished the members at least two (2) days before the scheduled meeting.
SEC. 6.4 Quorum. – A majority of the meber of their alternate representaives shall constitute a quorum to proceed with the meeting.
SEC. 6.5 Election of the Vice Chairperson – The members shall vote among themselves a Vice Chairperson who shall have a term of three (3) years and shall serve not for more than two (2) consecutive terms. In case of vacancy due to retiremnt, resignation, transper, incapacitation or death, the members may nominate from among themselves a replacement to serve the unexpired portion of the term. The filling up of an unexpired term of an outgoing Vice Chairperson shall already be considered one full term in reckoning his/her number of terms.
SEC. 6.6 Responsibilities of the Vice Chairperson. – The Vice Chairperson shall have the following responsibilities:
(a) Act as Chairpeson and preside over meetings of the Special Committee in the absence of the Chairperson;
(b) In the absence of the Chairperson, act on matters requiring immediate decision: Provided, That a report thereon shall be submitted to the Chairperson within (5) days; and
(c) Perfom such other functions and duties as may be directted by the Chairperson.
Rule VI
FUNCTIONS OF THE NAMCYA FOUNDATION
SEC. 7. Functions of the NAMCYA Foundation. – The NAMCYA Foundation, represented by its President, shall monitor and supervise the daily operations, and serve as the Secretariat in the planning and implementation of activities of NAMCYA. The NAMCYA Foundation shall specifically perform functions such as, but not limited to the following:
(a) Formulate and facilitate the review, development, and evolution of the NAMCYA policies, plans, and programs for the approval of the NAMCYA Foundation Board of Trustees and shall then submit the same for the review of the NAMCYA policies, plans, and programs;
(b) Prepare necessary progress and annual reports to the NAMCYA Special Committee regarding the implementation of the NAMCYA policies, plans, and programs;
(c) Prepare the annual budget and submit the same to the NCCA for inclusion in the annual General Appropriations Act (GAA);
(d) Establish and maintain a work system for the effective and efficient management of the NAMCYA policies, plans, and programs; and
(e) Maintain the NAMCYA records and documentations and undertake other tasks necessary to achieve the abovementioned functions of the NAMCYA Foundation.
Rule VII
ENTITLEMENTS OF THE NAMCYA ASSISTANCE, BENEFITS, AND PRIVILAGES FROM THE GOVERNMENT AGENCIES
SEC.8. Entitlements. – The NAMCYA shall be entitled to avail the assistance, benefits and previlages from the following government agencies:
(a) The CCP shall provide free use of venue and facilities for NAMCYA competitions, festivals, productions, and performances, and office space for the Special Committee secretariat: Provided, that a reasonable amount for utilities, and other direct costs may be charged: Provided, further, that the schedule for the use of venue and facilities shall be subject to the mutual agreement of CCP and NAMCYA Foundation;
(b) The NCCA shall give preference to project proposals under NAMCYA and provide continuous financial and technical support for its competitions, festivals, scholarships, assistance, and research activities; Provided, That NAMCYA project proposals shall be subject to proper evaluation pursuant to requirements of the NCCA grants system and subject to availability of funds and existing of funds and existing government auditing rules and regulations;
(c) The DepEd and the Commission on Higher Education (CHED) shall assist in the identification, selection, and training of participants from the different regions of the country. The DepEd, CHED, and state universities and colleges shall also provide free use of respective venues and facilities subject to a mutual agreement for local competitions and festivals under NAMCYA;
(d) The DILG and local government units (LGUs) are hereby authorized to utilize their respective funds, including Local School Board (LSB) funds, in the selection and training of participants and in the conduct of local competitions and festivals. LGUs shall also provide free use of venues and facilities for NAMCYA activities and assistance in the conduct of research projects;
(e) The NYC shall promote and encourage the active participation of the youth in all local music competitions and festivals under NAMCYA;
(f) The DOT shall advance and promote cultural tourism by encouraging local and foreign tourists to participate in performing arts and cultural tours, traveling to festivals, and other cultural activities;
(g) The DICT shall assist the NAMCYA Special Committee to connect, through digital platforms, with the LGUs and educational institutions to enable the conduct of online musical training, competitions, and festivals;
(h) The PIA shall assist the NAMCYA Special Committee in disseminating information nationwide about its activities, projects, and services to the young Filipino musical artists and talents; and
(i) Government-owned and controlled corporations (GOCCs) are hereby authroized to give donations and grants to the NAMCYA subject to their rules and regulations.
Rule X
AMENDMENTS
SEC. 11 Amendments. – Any amendments to this Implementing Rules and Regulations (IRR) shall be approved by the NCCA Board of Commissioners, in consultation and coordination with the NAMCYA Foundation, the CCP, and other concerned government agencies.
Rule XI
FINAL PROVISIONS SEPARABILITY, REPEALING, AND EFFECTIVITY CLAUSES
SEC. 12. Separability Clause. – If any provision of this IRR is held invalid or unconstitutional, the other provisions not so declared shall remain in force and effect.
SEC. 13. Repealing Clause. – All laws, presidential decrees or issuances, executive orders, letters of instruction, administrative orders, rules, or regulations contray to or inconsistent with the provisions of this Act are hereby repealed, modified or amended accordingly.
SEC. 14. Effectivity. – These implementing rules and regulations shall take effect fifteen (15) days after the completion of its publication in the Official Gazette or in a national newspaper of general circulation.

ANNEX “A”
DEFINITION OF TERMS
For the purposes of this IRR, the following terms shall be defined as follows:
a. NAMCYA – refers to the National Youth Development Program for Music that will promote high standards of excellence in Music.
b. NAMCYA Foundation – refers to the Secretariat as designated by law for the planning and implementations of NAMCYA.
c. Musical Traditions – refer to traditional music expressions such as folk, classical music, and world music.
d. Philippine music – refers to traditional music expressions such as folk, classical music, world music, and music education condition in the Philippine context.
e. Special category – refers to competition categories that are not usually presented such as chamber music, symphonic band, music video production, etc.
f. Workshops for music classroom teachers and students – refer to workshops on any topic, usually Music Education and Traditional Music that will augment classroom materials for music teachers and students.
g. Workshops for non-music classroom teachers and students – refer to workshops on any topic, usually Music Education and Traditional Music that will augment classroom materials for non-music teachers and students.
h. Traditional music expressions – refer to traditional music forms in any many non-western cultures, various expressive modes which include singing, speech, the use of instruments, body movement/s, and traditional attire. The concept of ‘traditional’ is based on the notion that these expressive forms are performed as part of everyday life and/or during special events in the community, and thus are part of the cultural heritage and identity of the community.
i. Start-up workshops – refers to workshops which will equip communities with the knowledge and training on how to start their own musical groups such as choirs, rondallas, traditional music groups and the like.
j. Capacity building workshops – refer to NAMCYA’s capacity building workshops focus on training, educational inputs and sustainability, helping existing groups improve their capability to perform, produce and utilize their talents.
k. Outreach performances – refer to the NAMCYA winners from different categories, past and current, and they are presented in performances designed to help raise awareness of NAMCYA and its activities. These are usually held in the regions and/or other areas that may benefit from these activities.
l. Commissioned work – refers to a musical work specially and expressly commissioned by the NAMCYA from a composer/writer.
ANNEX “B”
NAMCYA ACTIVITIES
The NAMCYA program of activities includes, but is not limited to, the following:
I. Competitions – Competitions will be on a three-level process.
(a) Elimination Round – Video and or Actual Auditions for big groups, including the traditional music genres, and solo performers.
(b) Semifinal Round – Public performances of those who qualified in the Elimination Round to be held in various venues around the Philippines that will determine who qualifies for national final round.
(c) National Final Round – a weeklong festival of final competitions of those who qualified in the Semifinal Round to be held at the various venues of the Cultural Center of the Philippines (CCP) to determine the winners. This round is part of the activities celebrating the National Music Week pursuant to Presidential Proclamation No. 1173.

III. Workshops. – Workshops for oerformers and classroom teacher and trainors, are integrated during the provincial sorties of the semifinal rounds. Some persons who may be considered as experts by NAMCYA on differents categories subject of the copetitions shall facilitate the workshops. Aside from the workshops integrated with the semifinals, several workshops shall likewise be held continually and spread out for the year, viz:
(a) Workshops for music classroom teachers and students;
(b) Workshops for non-music classroom teachers and students;
(c) Online hands-on workshops for traditional music expressions;
(d) Online hands-on workshops for choir trainors and choir members;
(e) Online hands-on workshops for rondalla trainors and members;
(f) Online hands-on workshops for symphonic band/marching band/drum and lyre/ drum and bygle including major and majorette trainors and members;
(g) Online hands-on workshops for string players;
(h) Start-up workshops (building choirs, symphonic bands, rondalla, etc.);
(i) Capacity building workshops.
IV. Outreach Concerts/Educational Presentations/Concert of Winners Series – There activities aim to showcase previous winners in various venues not limited to the National Capital Region but all over the country. This is going to be in partnership with the Cultural Center of the Philippines (CCP) and its Arts Education and Outreach Programs. It shall be in the mode of an educational activity through a series of either an outreach performance, a public formal recital/concert or a school concert.
V. Commissioned Works. – New works for the competition shall be commissioned to add to the rich literature of the young musical artist’s repertoire.
VI. Publication of Works. – Commissioned works, extant Filipino compositions and other ancillaries such as video and audio recordings as well as books shall be continually published (original or reprints).
VII. Festivals. – The festivals will be channels for presenting seasoned Filipino performers here and abroad. These will also be platforms for performances presenting young and aspiring musicians, for alternative teaching opportunities for music teachers.
VIII. Scholarships. – NAMCYA shall be instrumental in facilitating and providing scholarships to deserving young and talented musicians.
IX. National and International Tours. – NAMCYA shall mount National and International Tours of Filipino musicians as “Ambassadors of Goodwill” especially on cultural exchange endeavors.
