DE LA SALLE – COLLEGE OF ST. BENILDE, PETITIONER, V. DEPARTMENT OF LABOR AND EMPLOYMENT – NATIONAL CAPITAL REGION AND DLS-CSB STAFF EMPLOYEES UNION, RESPONDENTS.

Decisions / Signed Resolutions January 30, 2014 SPECIAL TWELFTH DIVISION ELBINIAS, J.:

ELBINIAS, J.:

Before Us is petitioner’s “MANIFESTATION AND MOTION TO WITHDRAW PETITION”[1] (“Motion to Withdraw” for brevity), praying that the Petition for Certiorari[2] at bench be withdrawn.[3] Petitioner stated the following, among others:

“5. Given the termination of the case before public
respondent, it is apparent that the instant Petition has been rendered
moot and academic.

6. Consequently, petitioner begs the indulgence of this
Honorable Court and respectfully withdraws the instant Petition and/or
move for its dismissal.
Furthermore, petitioner likewise manifests
that it is no longer filing a Reply to private respondent’s Comment in
view of the foregoing developments.

xxx

WHEREFORE, it is respectfully prayed that the instant Petition be deemed withdrawn and/or dismissed.”[4] (Emphasis supplied)

Given that petitioner, in its Motion to Withdraw[5], sought the withdrawal of the very Petition it filed, then the withdrawal of petitioner’s Petition for Certiorari[6] is justified.

WHEREFORE, petitioner’s prayer[7] for the withdrawal of its Petition for Certiorari is GRANTED. The Petition at bench is considered WITHDRAWN, and, the case is deemed CLOSED and TERMINATED.

SO ORDERED.

Dicdican (Chairman) and Dimagiba,[*] JJ., concur.
