ROSE CHAN FUENTES, PETITIONER-APPELLANT, V. PEOPLE OF THE PHILIPPINES, REGIONAL TRIAL COURT OF MANILA, BRANCH 39, HEIRS OF JULIO MATIAS, RESPONDENTS-APPELLEES.
TOLENTINO, A.G., J.:
In our Minute Resolution dated December 10, 2013[1], we directed the petitioner to rectify the defects in the petition before we take initial action on it. It was received by the petitioner’s counsel on December 17, 2013.[2] However, despite receipt, no compliance has been filed by the petitioner’s counsel as per CMIS Verification Report dated March 7, 2014.[3]
In the March 13, 2014 Minute Resolution,[4] the petitioner was required to SHOW CAUSE why the petition should not be dismissed for failure to comply with the Court’s December 10, 2013 Minute Resolution. The records show that it was duly received by the petitioner’s counsel on March 24, 2014[5] but despite receipt thereof, no show cause has been filed by him.[6]
WHEREFORE, in view of the failure of the petitioner to comply with the Minute Resolutions dated December 10, 2013 and March 13, 2014, the instant case is hereby DISMISSED.
SO ORDERED.
