PHILIPPINE GEOTHERMAL, INC., (NOW CHEVRON GEOTHERMAL PHILIPPINES HOLDINGS LLC), PETITIONER, VS. NATIONAL LABOR RELATIONS COMMISSION, CHARLES B. HANKINS, JR., ET AL., RESPONDENTS.
Decisions / Signed Resolutions March 5, 2014 SEVENTEENTH DIVISION BATO, JR., J.:
BATO, JR., J.:
Acting on petitioner’s Withdrawal of Petition[1]
dated March 5, 2014, stating, among others, that it is no longer
pursuing the instant petition, despite private respondents’ objection
anchored on the ground that they have raised “issues and claims in the
nature of a counter claim” embodied in their Manifestation Of Compliance With Comments dated April 15, 2014, considering petitioner’s Counter-Manifestation
dated May 7, 2014 that the assailed Consolidated Decision dated June
17, 2013 and Consolidated Resolution dated July 31, 2013 of the NLRC
have become final and executory in so far as private respondents are
concerned because they have not filed a separate and independent
petition assailing the same, considering further the ruling of the
Supreme Court in the case of Unilever Philippines Inc. vs. Maria Ruby Rivera[2],
that “a party who does not appeal, or file a petition for certiorari,
is not entitled to any affirmative relief”, the withdrawal of the
petition is GRANTED.
