NAPOLEON R. REFUGIDO, ALEX PURAL, JOEY AGUIRRE, BERNIE J. LLORENTE, JOEL A. DADIZON AND MEL T. MAGALLANES, PETITIONERS, VS. NATIONAL LABOR RELATIONS COMMISSION, METRO PSYCHIATRY…
BALTAZAR-PADILLA, J.:
“WHEREFORE, premises considered, the instant petition is hereby GRANTED.
Private respondent is hereby ORDERED to pay double the salary differentials of petitioners, the difference of their benefits in terms of overtime pay, night differential, holiday pay and 13th month pay, the last to refer only to petitioner Aguirre.
Private respondent is also ORDERED to pay ten percent (10%) of the total monetary award as attorney’s fees.
Interest at the rate of six percent (6%) per annum shall be imposed on all monetary awards from date of finality of this Decision until full payment.
The Labor Arbiter concerned shall make the necessary computation on the basis of the entries in the monthly summaries of petitioners’ wages and benefits submitted by private respondent.
SO ORDERED.”[1]
Dissatisfied therewith, private respondents filed a Motion for Reconsideration of the said Decision.
A judicious evaluation of the said Motion for Reconsideration discloses that no convincing and justifiable reason was advanced by the movants that would convince US to modify, alter, much less, reverse the questioned Decision. The allegations and arguments therein embodied had already been amply discussed and passed upon by US. To reiterate OUR ruling on the same will only result in mere redundancy.
WHEREFORE, on account of the foregoing, the subject Motion for Reconsideration is hereby DENIED.
SO ORDERED.
