The records of the case show that on December 13, 2013, We received Sheriff’s Return of Service infomring Us that Summons was duly served upon private respondent on November 29, 2013.[1]
The records further reveal that DSPK Holding Limited Company had filed its Answer with Counterclaim[2] on December 06, 2013. Comment[3] thereto was also submitted by petitioners.
Issues now having been joined, let the Preliminary Conference pursuant to Rule 48 of the Revised Rules of Civil Procedure be set on April 24, 2014 at 10:00 0’clock in the morning at the Session Hall of the Court of Appeals-Mindanao Station, YMCA Building, J. Pacana St., Cagayan de Oro City.
Parties herein are required to submit their respective pre-trial brief at least three (3) days before the aforesaid date.
