Before this Court is a Manifestation with Motion to Withdraw Petition filed by petitioners praying that the instant petition be considered withdrawn and declaring the case closed and terminated in view of the fact that private complainants Ermina R. Asuncion, Richard E. Sagun and Arnel Flores Pascual, had executed their respective affidavits of desistance in favor of all the accused (herein petitioners) in Criminal Case Nos. 148670, 148671 and 148672. Copies of the affidavits are attached to the Manifestation and Motion as Annexes “A” to “C” . Likewise, the court a quo issued an order dated October 23, 2013 (Annex “D”), dismissing the cases against accused Roberto M. Flogen, Edgardo R. Conde, Joey V. Rodriguex, Mario R. Pagkalinawan, Ruel Rodriguez and Rhayson Ungco (herein petitioners).

WHEREFORE, finding merit in the instant motion, the same is hereby GRANTED. The petition for certiorari is deemed WITHDRAWN and this case is now considered CLOSED and TERMINATED.
