PEOPLE OF THE PHILIPPINES, PLAINTIFF-APPELLEE, VS. RAMON SAJA MAHOMAS, ACCUSED-APPELLANT.

Decisions / Signed Resolutions June 26, 2014 SPECIAL TWENTIETH DIVISION QUIJANO-PADILLA, J.:

QUIJANO-PADILLA, J.:

After We declared this case submitted for decision on September 13, 2013,[1] the Public Attorney’s Office, in representation of accused-appellant, filed a Motion to Withdraw Appeal.[2] Attached to the motion were the Affidavit[3] and letter[4] of accused-appellant declaring his intention to withdraw his appeal. Considering that plaintiff-appellee had already filed its brief, this Court withheld its action on the motion and directed instead the Office of the Solicitor General (OSG) to comment thereon.[5]

On May 12, 2014,[6] the OSG filed a Manifestation that it does not interpose any objection to accused-appellant’s motion.

IN VIEW THEREOF, accused-appellant’s motion is GRANTED. The appeal is considered WITHDRAWN and this case is hereby DISMISSED.

Accordingly, let the corresponding Entry of Judgment be issued and recorded in the Book of Entries of Judgment of this Court.

SO ORDERED.
