PAULO R. CABANLIT, PETITIONER, VS. PEOPLE OF THE PHILIPPINES RESPONDENT.

Decisions / Signed Resolutions TWENTIETH DIVISION LEGASPI, J.:

LEGASPI, J.:

A perusal of the above-captioned Petition for Review under Rule 42 of the Revised Rules of Court reveals the following infirmities:

  1. The petition was filed out of time;
  2. The Public Attorney’s Office (PAO) failed to alleged in the petition the date when it received the assailed Decision of the Regional Trial Court (RTC); and
  3. Some relevant pleadings and documents, which are necessary for a better understanding and resolution of the instant petition were not attached, such as, but not limited to: the respective Position Paper of the parties, the Republic’s Memorandum of Appeal and its annexes; and, other pertinent documents and affidavits adduced before the public respondent.

ACCORDINGLY, the Court resolves to DISMISS this petition for being filed out of time and in view of the above-stated defects.

SO ORDERED.
