Finding the allegation therein to be impressed with merit, the Court resolves to GRANT the same.
Thus, the petition, in so far as petitioner Gregorio B. Castromayor is concerned is hereby ordered WITHDRAWN.
Scrutiny of records showed that petitioners in the Resolution dated October 30, 20132, were directed to file their memorandum within fifteen (15) days from notice. However, per Judicial Records Division (JRD) Report3 dated February 19, 2014, no memorandum has been filed, hence, petitioners are deemed to have waived the filing of the same and the instant petition is now SUBMITTED for DECISION.
FURTHERMORE, the Division Clerk of Court, 21st Division is hereby DIRECTED to issue a Partial Entry of Judgment pursuant to Sec. 1 (b), Rule VII, 2009, IRCA as to petitioners Alan Asuque, Russel Asuque, Ramil A. Batitiw, Josue O. Meñoza, Charles Angeles Constancia, Louie O. Saygad, and Randy L. Amora.
