PEOPLE OF THE PHILIPPINES, PLAINTIFF-APPELLEE, VS. EFREN CLAUD Y GAA AND APOLONIO IGNO, JR., ACCUSED-APPELLANTS.
Decisions / Signed Resolutions August 27, 2014 FORMER FOURTH DIVISION CARANDANG, J.:
CARANDANG, J.:
We find no justifiable reason to reverse or set aside Our Decision[1] dated August 27, 2014 affirming accused-appellants’ conviction.
[1] Rollo, pp. 71-78
The inconsistencies of the testimonies of prosecution’s witnesses are too trivial and inconsequential to warrant the reversal of accused-appellants’ conviction. We reiterate Our ruling that Spouses Villaruel positively identified both appellants as the persons who actually robbed them in their house, and both accused-appellants conspired in committing the robbery as the coordinated acts of them were clearly established by the prosecution’s evidence.
ACCORDINGLY, accused-appellants’ twin Motion for Reconsideration[2] of Our Decision dated August 27, 2014 is DENIED.
SO ORDERED.
Gonzales-Sison, and Sorongon, JJ., concur.
