LOIDA DE BELEN, PETITIONER, VS. REPUBLIC OF THE PHILIPPINES, ET AL., RESPONDENTS,
MACALINO, J:
Section 1, Rule 42 of the Rules of Court states that:
“Section 1. How appeal taken; time for filing. —
xxx
Upon proper motion and the payment of the full amount of the docket and other lawful fees and the deposit for costs before the expiration of the reglementary period, the Court of Appeals may grant an additional period of fifteen (15) days only within which to file the petition for review. No further extension shall be granted except for the most compelling reason and in no case to exceed fifteen (15) days.”
The said motion is hereby granted. However, per Judicial Records Division report, as of April 25, 2014, no Petition for Review was filed by petitioner.[2] Pursuant to the above provision, since petitioner failed to file a Petition for Review on or before April 6, 2014, the instant petition is now considered ABANDONED and DISMISSED.
This Court notes the compliance by the Head of the Judicial Records Division with our Resolution dated March 31, 2014,[3] reclassifying this case from its classification as special case, with docket number CA-GR SP No. 134505 to criminal case, with docket number CA-GR CR No. 36472.
We likewise note the withdrawal[4] of Ferancullo Evora Askali Law Firm as counsel of petitioner, with the conformity of the latter.
WHEREFORE, the petition is hereby deemed ABANDONED and DISMISSED.
