MA. BELINDA R. CUSI-SAN JOSE, PLAINTIFFS-APPELLANT, VS. RAFAEL R. SAN JOSE, RESPONDENT-APPELLEE,

Decisions / Signed Resolutions December 3, 2012 SECOND DIVISION SALAZAR-FERNANDO, J.:

SALAZAR-FERNANDO, J.:

On August 29, 2014, this Court declared the marriage between the parties as valid and subsisting, affirming the Decision[1] dated December 3, 2012 and the Order[2] dated February 5, 2013 of the Regional Trial Court (RTC), Branch 225, Quezon City in Civil Case No. Q-08-63907.[3] On September 25, 2014, petitioner-appellant filed a Motion for Reconsideration,[4] still insisting that she was prejudiced by the alleged gross negligence committed by her previous counsel in handling the present petition and demanded that the case be remanded to the lower court for further proceedings. The Office of the Solicitor General (OSG) was required to comment[5] on the motion, and the same was filed on November 11, 2014.[6]

A careful examination of the motion shows that petitioner-appellant failed to present a new issue as the matters alleged in the motion were already been considered and ruled upon by this Court in its assailed decision. Consequently, without any new matter that would justify a reconsideration, this Court will uphold its ruling.

WHEREFORE, premises considered, petitioner-appellant’s Motion for Reconsideration is hereby DENIED for lack of merit.

SO ORDERED.
