Decisions / Signed Resolutions February 20, 2013 FORMER SECOND DIVISION SALAZAR-FERNANDO, J.:

SALAZAR-FERNANDO, J.:

On September 25, 2014, this Court denied the appeal[1] and affirmed the Decision[2] dated February 20, 2013 of the Regional Trial Court (RTC), Branch 78, Morong, Rizal in Civil Case No. 05-1736-M, dismissing plaintiff-appellant’s complaint on the ground of prescription. On October 24, 2014, plaintiff-appellant filed a Motion for Reconsideration[3] contradicting this Court’s findings and insisting that the prescriptive period for filing its complaint before the lower court was effectively tolled by the demand letter dated February 25, 2005 sent to defendants-appellees. In their Comment[4] filed on March 5, 2015, defendant-appellees prayed that the motion be denied because it failed to present a new issue that would warrant a reconsideration of this Court’s assailed decision.

A review of the motion shows that plaintiff-appellant made the same contentions in its previous pleadings. These arguments were already considered and ruled upon by this Court in its assailed decision. Sans a new issue that would justify a reconsideration, this Court will not disturb its previous findings.

WHEREFORE, premises considered, plaintiff-appellant’s Motion for Reconsideration is hereby DENIED for lack of merit.

SO ORDERED.
