HEIRS OF JOSE DEL ROSARIO, NAMELY: TEOFILA DEL ROSARIO, RODEL DEL ROSARIO AND GREGORIO DEL ROSARIO, PETITIONERS, VS. SPOUSES ANTONIO PANGANIBAN AND REGINA PANGANIBAN, RESPONDENT.

In a “Motion for Extension of Time to File Petition”^[1] filed before this Court on July 8, 2014, petitioners sought an extension of fifteen (15) days to file a Petition for Review.

On July 22, 2014, this Court issued a Minute Resolution^[2] granting petitioners an extension of fifteen (15) days from July 8, 2014 or until July 23, 2014, within which to file the intended Petition for Review and directing the counsel for petitioners to submit his updated IBP OR number and Affidavit of Service of copy of the Motion upon the adverse parties.

Subsequently, or on July 24, 2014, petitioners filed a “Second Motion for Extension of Time to File Petition”^[3] praying for an additional fifteen (15) days to file the said petition. In this Court’s Minute Resolution dated July 30, 2014,^[4] petitioners were granted a second extension of fifteen (15) days or a total of thirty (30) days from July 22, 2014 or until August 5, 2014 within which to file the petition.

Per Case Management Information System (CMIS) verification dated September 11, 2014,^[5] no Petition for Review had been filed by the petitioners.

ACCORDINGLY, for failure of petitioners to file the Petition for Review despite the second extension of time granted by this Court in its Resolution dated July 30, 2014, the instant case is considered ABANDONED and is now ordered DISMISSED.
