SALCEDO’S BANANA FARM, ET AL. PETITIONERS, VS. HONORABLE NATIONAL LABOR RELATIONS COMMISSION (EIGHT DIVISION), ET AL., RESPONDENTS.

Decisions / Signed Resolutions December 9, 2014 FORMER SPECIAL TWENTY FIRST-DIVISION SINGH, J.:

SINGH, J.:

On November 20, 2014, the Court issued a Resolution dismissing the petition,[1] a copy of which was received by the petitioners on December 4, 2014.[2]

On December 18, 2014, a “Motion For Reconsideration” was filed by petitioners.

In the interest of justice, and in order to afford the petitioners an opportunity for review of the case rather than to dispose of the same on a technicality, the “Motion For Reconsideration” is hereby GRANTED and the petition is reinstated.

Consequently, and without necessarily giving due course to the petition, the private respondents are directed to file a comment (not a motion to dismiss) and to show cause why a temporary restraining order and/or writ of preliminary injunction should not be issued, within ten (10) days from notice, to which petitioners may file a reply within five (5) days from receipt of the comment.

Counsel/parties are directed to promptly notify this Court of any pending and/or subsequent filing of any case involving the same parties and issues. (A.M. No. CA-13-51-J).

SO ORDERED.

Borja, J., Chairperson and Santos, JJ., concur.
