ELSIE T. GUCOR, PETITIONER, VS. NATIONAL LABOR RELATIONS COMMISSION, LABOR ARBITER NOEL AUGUSTO S. MAGBANUA, NEW FIVE STAR AGRO MACHINERIES AND EQUIPMENT CENTER AND/OR RAMON A. …

Decisions / Signed Resolutions September 30, 2014 TWENTY-FIRST DIVISION SINGH, J.:

SINGH, J.:

Submitted for the resolution of this Court is the private respondents New Five Star Agro Machineries and Equipment Center (New Five Star) and Ramon A. Abad’s (Abad )Motion for Reconsideration[1] of this Court’s Decision[2] dated 30 September 2014, together with the Opposition[3] dated 17 November 2014 filed by petitioner Elsie Gucor (Gucor).

In moving for reconsideration, private respondents argue, among others, that public respondent National Labor Relations Commission (NLRC) correctly ruled that petitioner Gucor was not illegally terminated from employment. Thus, public respondent NLRC did not act with grave abuse of discretion amounting to lack or excess of jurisdiction because the NLRC resolved the case after a thorough examination and evaluation of the facts and evidence.

Private respondents New Five Star and Abad failed to raise any new and valid argument to warrant a reversal of the assailed Decision. The arguments are a mere rehash of issues which have been exhaustively discussed and passed upon by this Court in the assailed Decision. The motion is thus pro-forma.[4]

ACCORDINGLY, the Motion for Reconsideration filed by New Five Star Agro Machineries and Equipment Center and Ramon A. Abad is denied for lack of merit. The Decision dated 30 September 2014 stands unreconsidered.

SO ORDERED.
